Twickr Terms of Service

Welcome to Twickr.
These Terms of Service ("Terms") govern your access to and use of Twickr,
including our websites, applications, services, content, technology,
features, and products (collectively, the "Service").
By creating an account, accessing, or using Twickr, you agree to be bound by
these Terms and all applicable laws and regulations.
If you do not agree, you may not access or use the Service.
Twickr reserves the right to suspend, restrict, or terminate access to the
Service at any time where necessary to protect users, comply with law,
enforce platform rules, or maintain service integrity.
1. Eligibility
You must be at least 13 years old, or the minimum age required by law in your
jurisdiction, to use Twickr.
By using the Service, you represent and warrant that:
- You meet all age requirements.
- You have legal capacity to enter these Terms.
- The information you provide is accurate.
- You will comply with applicable laws.
2. User Accounts
You are responsible for maintaining the security of your account and password.
- You may not share your account credentials.
- You may not impersonate another person or organization.
- You may not create misleading identities.
- You are responsible for activity occurring under your account.
- You must promptly notify Twickr of unauthorized access.
3. User Content
You retain ownership of content you create and publish on Twickr, including
Sticky Notes, photos, videos, Flips, SoundBites, messages, and other creative content.
By posting content, you grant Twickr a worldwide, non-exclusive,
royalty-free license to host, store, reproduce, distribute, display,
process, adapt, and make available such content solely for operating,
improving, securing, promoting, and providing the Service.
You represent that you possess all rights necessary to publish the content.
4. SoundBites & Record Labels
SoundBites are Twickr's audio creation and sharing feature that allows users
to publish short audio experiences, voice clips, reactions, and creative recordings.
This includes music, podcasts, and other audio content that may be associated with
record labels, publishers, or other rights holders.
By using SoundBites, you agree that:
- You only upload audio content that you own or have explicit permission to use.
- You are responsible for any voices, music, recordings, or sounds you publish.
- You will not use SoundBites to spread harmful, abusive, threatening, or misleading content.
- You will not upload copyrighted audio without appropriate authorization from all rights holders.
- You will not use manipulated audio to impersonate others or deceive users.
Record Label & Rights Holder Requirements
If you are uploading audio content associated with a record label, publisher, or
any third-party rights holder, you represent and warrant that:
- You have obtained all necessary licenses, permissions, and authorizations from the record label, publisher, performers, producers, songwriters, and any other rights holders.
- You have the legal right to distribute, stream, and make available such audio content on the Twickr platform.
- You will comply with all applicable copyright laws, including but not limited to the Digital Millennium Copyright Act (DMCA), Copyright Act, and international copyright treaties.
- You will provide accurate and complete metadata, including artist names, record label information, songwriter credits, and publisher details when required.
- You will not attempt to circumvent or bypass any digital rights management (DRM) or content protection systems.
- You understand that Twickr does not provide music licensing services and is not responsible for obtaining licenses on your behalf.
Copyright & Intellectual Property
Twickr respects intellectual property rights and complies with applicable copyright laws.
Users must ensure they have the right to upload and share audio content. Unauthorized
uploading of copyrighted material, including music owned by record labels, publishers,
or other rights holders, is strictly prohibited and may result in:
- Immediate removal of the infringing content.
- Account suspension or termination.
- Legal action by rights holders.
- Reporting to relevant authorities.
DMCA & Copyright Infringement
Twickr responds to valid DMCA takedown notices and other copyright infringement claims.
If you believe your copyrighted work has been posted on Twickr without authorization,
you may submit a copyright infringement notice to our designated agent. Conversely,
if your content is removed due to a copyright claim, you may submit a counter-notice
if you believe the removal was erroneous.
Record Label Icon & Branding
When uploading SoundBites associated with a record label, you may include record
label icons, logos, or branding only if:
- You are authorized to use such branding by the record label.
- The branding is used accurately and in a manner consistent with the record label's brand guidelines.
- The branding does not mislead users about the source, sponsorship, or endorsement of the content.
- You do not use branding to impersonate or falsely represent affiliation with any record label.
Twickr reserves the right to remove or modify record label branding that violates
these provisions or applicable laws.
Enforcement
Twickr may remove SoundBites, limit audio features, reduce distribution,
demonetize content, or take enforcement action when audio content violates these Terms,
Community Guidelines, or applicable laws, including copyright infringement.
Twickr cooperates with record labels, publishers, and rights holders to protect
intellectual property and may share user information when required by law or to
respond to valid legal claims.
5. Identity Verification
Twickr offers a voluntary identity verification program that allows users to request a verification badge to confirm their authenticity and build trust within the community.
The verification process is entirely optional and users may participate at their discretion.
By submitting a verification request, you agree to the collection and processing of verification data as described in this section.
Verification Data Collection
For identity verification purposes, Twickr may collect and process the following sensitive information:
- Government-issued identification documents (e.g., national ID card, passport, driver's license)
- Personal identification information including full legal name, date of birth, and identification numbers
- Photographs of identification documents submitted through the verification request system
- Selfie photographs for identity confirmation purposes
- Additional documentation or evidence as requested by Twickr verification administrators
- Timestamps and metadata related to verification request submission and review
- Administrative notes and review decisions regarding verification requests
How Verification Data Is Used
Twickr processes verification data for the following legitimate purposes:
- Identity verification to confirm user authenticity and prevent impersonation
- Age verification to ensure compliance with age restrictions and legal requirements
- Preventing fraud, fake accounts, and abusive behavior
- Enhancing platform security and trustworthiness
- Compliance with legal and regulatory obligations
- Reviewing and processing verification requests by authorized administrators
- Displaying verification badges to users who successfully complete the verification process
Verification Data Protection
Twickr implements industry-standard security measures to protect verification data:
- All verification documents are stored securely using Firebase Storage with encryption in transit and at rest
- Verification data is only accessible to authorized Twickr administrators with admin privileges
- Access to verification documents is logged and audited regularly
- Verification documents are deleted immediately after the verification request is approved or rejected
- Verification metadata (approval status, timestamps) may be retained for audit and compliance purposes
- Verification data is never shared with third parties except as required by law
- Verification data is never used for advertising, marketing, or commercial purposes
Your Rights Regarding Verification Data
You retain the following rights regarding your verification data:
- Participation in verification is voluntary and optional
- You may withdraw your verification request at any time before review
- You may request deletion of your verification data at any time
- You may request access to what verification data Twickr holds about you
- Verification data will be permanently deleted upon account deletion
- You may request correction of inaccurate verification data
Prohibited Activities Related to Verification
The following activities are strictly prohibited and may result in immediate rejection of verification request, permanent ineligibility for verification, account suspension or termination, reporting to law enforcement authorities, or legal action:
- Submitting false, forged, or altered identification documents
- Submitting identification documents belonging to another person
- Misrepresenting your identity or personal information
- Attempting to bribe or influence verification administrators
- Creating multiple verification requests with conflicting information
- Using stolen or fraudulently obtained identification documents
- Impersonating another person to obtain verification
Verification Badge Display
The verification badge displayed next to verified usernames indicates that the user has successfully completed identity verification, but:
- It does not imply endorsement of the user's content or behavior
- Verified users remain subject to all Community Guidelines and Terms of Service
- Twickr may revoke verification badges for violations of platform policies or Terms of Service
- Verification status is displayed in real-time and updates immediately upon approval or revocation
6. Prohibited Conduct
You agree not to:
- Violate laws or regulations.
- Harass, threaten, intimidate, or abuse others.
- Promote violence or criminal activity.
- Publish spam or deceptive content.
- Distribute malware or harmful code.
- Attempt unauthorized access to systems.
- Collect user data without permission.
- Interfere with platform operation.
- Manipulate engagement metrics or recommendation systems.
- Create fake accounts for abuse or deception.
- Post sexually exploitative content.
- Publish explicit sexual content, nudity, or pornographic material.
- Post sexually suggestive or inappropriate content.
- Publish hateful or discriminatory content.
- Share private information without authorization.
7. Moderation & Enforcement
Twickr may review, investigate, restrict, remove, disable, demonetize,
label, or otherwise moderate content and accounts that violate platform
rules or present risks to users or the Service.
Moderation decisions may be made using automated systems,
human review, or a combination of both.
Nothing in these Terms obligates Twickr to monitor all activity.
7. Intellectual Property
All Twickr branding, logos, software, technology, designs, source code,
features, trademarks, and intellectual property remain the exclusive property
of Twickr and its licensors.
Unauthorized copying, modification, reverse engineering, redistribution,
or commercial exploitation is prohibited unless expressly authorized.
8. Reporting Violations
Users may report content, accounts, or behavior believed to violate these
Terms, Community Guidelines, or applicable law.
Submitting a report does not guarantee removal, suspension, or enforcement.
9. Account Suspension & Termination
Twickr may suspend or terminate accounts for any of the following reasons:
- Violation of these Terms.
- Repeated policy violations.
- Fraudulent or deceptive activity.
- Security concerns.
- Legal requirements.
- Abuse of platform features.
- Protection of users or infrastructure.
Termination may result in loss of access to content, messages, followers,
connections, and account data.
10. Service Availability
Twickr is provided on an "AS IS" and "AS AVAILABLE" basis.
We do not guarantee uninterrupted availability, reliability, security,
performance, compatibility, or error-free operation.
Features may be modified, suspended, replaced, or discontinued at any time.
11. Limitation of Liability
To the maximum extent permitted by law, Twickr, its affiliates, employees,
officers, directors, partners, licensors, suppliers, and contractors shall
not be liable for indirect, incidental, consequential, special, punitive,
or exemplary damages arising from use of the Service.
12. Indemnification
You agree to defend, indemnify, and hold harmless Twickr and its affiliates
from claims, damages, liabilities, losses, expenses, and legal fees arising
from your use of the Service, content, or violation of these Terms.
13. Privacy
Your use of Twickr is also governed by the Privacy Policy.
14. Changes To These Terms
Twickr may modify these Terms at any time.
Updated versions become effective upon publication.
15. Governing Law
These Terms are governed by applicable laws governing Twickr operations.
